That is not an apple to apple comparison. A gun that is inside a loophole vs a normal gun.....

sounds like you dont know the law.. if something is legal and the cop thinks its illegal. he breaks the law by arresting you for it..
trust me on this,most beat cops dont know all the rules. you call their boss,he will know them before he shows.
you may sit on the side of the road for a bit,maybe even in the back of a car. but that sure beats going to jail. either way,if you are right,you are right..
LOL, You keep thinking that you do know the law. Officers wrongfully charge people all the time and it is thrown out of court. Guess where it will forever show up. A new rap sheet every time you have your background run. It may say dismissed but it'll still be there. Asking for the sergeant crap isn't like asking for the manager at Wendy's.

it is against the law for a cop to enforce what he thinks is the law. he can only enforce laws.
also,if he cant tell a nine from a foety,what does he know about a shotgun length?

cops are like anyone else, they will do what they can get away with. nothing evil about that,they are not nazis,just human.
but as much as it is their job to enforce laws,its our job to make sure they only enforce laws..

  • It’s not a handgun, because the barrel isn’t rifled and it is too long (overall length more than 26 inches).
  • It’s not a rifle, because it doesn’t have a rifled barrel and isn’t shoulder-fired.
  • It’s not an “any other weapon” (AOW). Despite the name sounding like a catch-all, it also excludes weapons with overall length more than 26 inches.
  • It’s not a shotgun. Under a more informal definition, this is the category it would clearly belong to, but legally these are “designed to be fired from the shoulder”, which the Shockwave isn’t.
  • It’s not a machine gun. It doesn’t fire multiple times when the trigger is pulled.
  • It’s not a “destructive device”. It doesn’t shoot rockets or mortars or anything like that, and while it does fire ammunition larger in diameter than .50 caliber, the definition excludes shotgun shells “generally recognized as particularly suitable for sporting purposes”, which 12 gauge shells clearly are.

By not falling into any of the categories of firearm, the Shockwave is regulated by laws that apply to firearms in general (like background checks, no ownership by felons, etc.), but not the additional regulations applying to any specific category of firearms. In particular, not being a shotgun from a legal perspective, the NFA regulations requiring extensive red tape on shotguns whose barrel length is less than 18 inches do not apply to this firearm.
This applies at the federal level. Some states use the same definitions, others do not.
