A great legal victory for Dem. Socialists .....and Libertarians ....and John Birch Conservatives

Everyone needs to step back a bit. I'm excited about the decision as well, but keep in mind, many civil asset forfeiture cases play out with the victim never being charged with a crime. The SCOTUS case relates to excessive penalties related to a conviction.

It's going to take some time for asset recovery cases to make their way through the courts, using this decision to recover unjustly seized property. The actual text of the decision, with the particulars of a forfeiture perpetrated against an un-indicted person, have to play out in the courts before this can be reliably used as a shield against civil rights violations.

It's a good start, but it's by no means over.

Unanimous decision, the 8th Amendment to the Constitution of the United States of America applies to the STATES, and no more "unreasonable" civil forfeitures. Overnight, local LEO and local government slush funds have been flushed down the crapper.

I'm not being factious, this is a great day for Joe Blow who is just going about his business when he gets busted for some crapola drug offense or such.

The consequence of this for the legal geeks is, not only are the seizures unlawful, BUT because SCOTUS has made doing so a constitutional protection, when some dumbass LEO agency keeps doing so on the theory that Bubba doesn't have the money to hire a lawyer to get his property back (the current SOP), they will find out that Bubba doesn't need any money because their conduct falls under federal civil rights acts, and there are plenty of lawyers who will take on Bubba's case.

For the real wonks, this is the actual decision. By modern Supreme Court standards, it is not too long - 26 pages.
