Small claims court.. If you have the guys information who actually sold it to you, and the conversation on face book its enough that Judge judy would award you your money back or send him to jail for contempt. If you get the right judge you might get lucky, if not you would be out $50 for filing, but it might be worth the risk

Why are you asking "what should I do"? You were robbed (you paid for something you can't use, was stolen, and the seller knows it.). The true owner of the phone was robbed. You know who the thief is. Not sure why this is even a question. 
sucks that u bought something that was stolen BUT the right thing to do is return it to the OWNER

How about bypassing the activation lock on the one i bought

You've already made the actual owner aware you have it so unless you want to change him bringing charges against you give it back. Go after the seller and get your money back
