Can a GA. Resident Private Sell a Rifle to an ALA Resident.

    This topic has always confused me. To the best of my understanding, private handgun sales from GA to ALA have to go thru a FFL. But I've got various answers on long guns. Private to private is allowed, but commercial to private has to go thru a FFL? They all have to go thru a FFL, private or not?

    I'm totally freaking confused.

    I've got an AR-15 I'd like to part with, and I'd considered selling it over in ALA (I've got family/friends over there). I just want to be crystal clear how it works and avoid any trouble.

    The problem is once you leave the state of your residency, it becomes an interstate commerce issue. You are right, but you are also wrong.

    1. Pistol transactions cannot happen outside of your home state, period. You can purchase a pistol from an FFL, say in Alabama, but they are required to send that pistol to a FFL in Georgia. Even if the Alabama dealer is five minutes from your house, he has to transfer that firearm to your Georgia dealer, even if they are further away from you (this used to be the issue with me when I lived in West Point, pawn shop in Lanett AL was closer than gun store in LaGrange GA.
    2. Rifle transactions can happen through an FFL. If you purchase a rifle through an FFL in Alabama, you can receive it from them. They aren't required to transfer the rifle to Georgia first.
    3. Private to private is not allowed interstate. Within the state depends on state laws, but is not an issue in Georgia.

    To remain completely legal, you would have to travel to Alabama, transfer the firearm to an FFL in that state, and allow them to do the paperwork, or they would have to travel to Georgia and do paperwork from a Georgia FFL after you've transferred the firearm to the Georgia FFL. To do it legally is going to cost you a transfer fee and some aggravation. I believe there might be an exception for Estates, not 100% but I think those guns end up just finding their way home because most people don't know the laws well in the first place.

    No. You need to use an FFL to transfer your rifle to an Alabama resident.

    For future reference, do shotguns fall under those same parameters?

    You'd be amazed how many different answers I've got to these questions.

    Yes, shotguns fall under those same parameters. Pretty much everything falls under those parameters except black powder.

    Long guns, any type. Handguns, any type. Your buyer has to take possession from an Ala. FFL. You can ship it, or you can "deliver it", but an FFL has to do the transfer for it to 100% BATFE approved.

    Simply, the purchaser of a hand gun has to have the transfer go through a FFL in the state of his residence/

    A long gun has to be transferred through a FFL in either the state of the seller or the state of the buyer. It is the parties choice in which state the transfer actually takes place.

    That is not a complete statement of the law. The buyer can take possession through a GA FFL. He doesn't HAVE to take possession through a AL FFL.
