How does that work though? Does the cop walk beside you and ask? If you're walking down the street and a cop stops to ask you for your permit for no other reason other than the presence of a gun is that a form of detention?

no. He can ask you if your have any weed, or have you shot anybody today, just like anyone else can. The point is you don't have to answer. if he detains you because of your answer, then different rules kick in.

Yeah I get that. I just wonder the likelihood of one walking away from that question without being stopped.

Depends on the training and experience of the LEO. Typically, more experienced know the rules and don't push the envelop. Less experienced, still stuck on "you will respect my authority."

What comes with experience is the realization that a bad bust just eats up the LEO time, and makes him look bad in the long run. Every body has a lawyer, so it's not going to slide by.

On the other hand, you have to decide what your time is worth to you. I have let stuff go by that was slam dunk just because it wasn't worth my time to pursue it.

I've been asked if I had bombs ,grenades , C4 , anti tank weapons on a BS traffic stop. Supposedly no license plate light . They will fish to get a reason ! Oh. His bad. My lights worked. He just couldn't see them because of his HIGH BEAMS !
last time I got stopped he said your tag light is out , so I walked back to check and a it was on , so I ask why did you stop me? all he said was have a good day and drove off

And there is the problem. A substantial number of traffic stops especially at certain times of the day, are pretextual.

Not most or a lot, but "some." So if the LEO doesn't push it what are you doing to do?

if you're car is reeking of weed, you will never have the chance to challenge the stop. If it's not, your only relief is to sue, and the cop has qualified immunity. So BFD.
 
OP, I counted 3 guys that i know are current LEOs and one former LEO answer your question.
They all gave the same answer. I hope you found what you were looking for, among all the overenthusiastic comments.
I hope you get your gun back and while it sucks to have to deal with it, it is a good thing you had it and protected yourself.
