Face to face question

looking at trading. Guy lives in TN and of course I’m in GA. Told him we’d have to ship since it’s over state lines. He replies with saying that he has a C&R license. Question is: does his C&R make the deal legal for me to receive a gun and give him one?

From what I’ve read it looks legal (bottom paragraph below)

Welll, I’m assuming both participants have to have a license for it to be legal but just wanted to be sure and the ATF will know. I just emailed them through there Firearms regulatory question link. No I didn’t give them any information, all I asked was “is it legal for a C&R holder to trade with a non C&R holder over state lines?” I’m obviously not gonna do it unless I have a clear answer. And if he won’t ship then it’s a no deal
 
Mr. Lowery:

This is in reply to your recent email to the Firearms Industry Programs Branch (FIPB) Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) asking if C&R rifles may be transferred across State lines if one of the individuals involved holds a Type 03 Collector of Curios & Relics (C&R) Federal firearms license (FFL).

The regulation at 27 CFR 478.50 states, in relevant part:

(b) A licensed collector may acquire curios and relics at any location, and dispose of curios or relics to any licensee or to other persons who are residents of the State where the collector's license is held and the disposition is made;

The holder of a C&R ffl may acquire C&R firearms at any location.

He may dispose / transfer C&R firearms to another FFL holder in any State.

He may only dispose / transfer C&R firearms face to face to a non-licensee (an individual who does not hold an FFL) who is a resident of the same State where the collector's license is held.
