False record affecting NFA background check

If you contact the FBI and get an Identity History Summary report it will help you. If its clean then contact atf and asked to re-submit with a copy of your clean report. they can expedite this type of re-submit for you as the FBI let you down. here is the link for a report https://www.fbi.gov/services/cjis/identity-history-summary-checks

If you can not get this issue fixed at the jail level the FBI can give you a UPIN that allows you to ID your self as the good guy not the jailbird

We received notice that your submission was disapproved due to an issue with the background check. There are several different options when it comes to how to proceed with this, and I have included those below. We have also CC’d your dealer to this email so that they are aware of the options as well.

The first step for either of these options would be to contact the ATF. You can call them at (304) 616-4500 (and select option 1 to speak to an operator). The operator will required your serial number, the name of your transferring dealer, as well as your registration information. That will allow them to pull up your submission in their system and transfer you over to your examiner.

Dispute:

If you feel that this was an erroneous disapproval, you can dispute. You would have to request what’s known as an Identity History Summary (or IHS). An IHS is basically a background check, but at the end of the process, the FBI will mail you an official document showing everything and anything that they would come across during a background check. What you would be looking for is for the document to state that there were no arrest records found when a check was done of your fingerprints/SSN. Resubmission:

If there are charges listed on the IHS, then unfortunately the ATF will view the disapproval as “valid”, even if the charges have been cleared, dropped, or expunged. This is usually caused by the police department/county records/courthouse not reporting the disposition to the federal level, which is why the FBI was not able to find the disposition. To resubmit, the ATF would ask that you include supporting documents showing what the outcome of the charges in question are (essentially doing the research for the FBI). Once you have those documents, you can email them to us at compliance@silencershop.com and we will upload them to your account and start the resubmission process.

Best info here . I’ve seen people denied only because the jaywalking ticket they had in 1998 was never closed out . File the appeal and it can all be cleared up.

That’s what happened is something was left open ended. I’ve found the hiccup, but NO ONE knows how (see: cares to) to fix it in the nics system
