Gun range sued by neighbors

WV specifically exempts shooting ranges from their noise ordinance and prevents nuisance claims against shooting ranges, the complaint was filed and not dismissed by the court.

Berkeley County Circuit Court and is before Circuit Court Judge Grey Silver who has not dismissed the case, moves it forward.

The private data the judge is demanding be provided to the plaintiffs:

– All member files
– All waivers from any person who has accessed PNTC, to include all law enforcement, federal agency personnel, military personnel and foreign military personnel names
– All shooting competition files and lists
– All training information and lists
– All customer waivers
– Identities of all persons who have used PNTC ranges
– All ATF & NFA records (to include Forms 4473 and ATF bound book information)

How does the judge even accept the complaint when the range is EXEMPT from the noise law???

That is a dang good question but of a larger concern for all ranges is the precedent of forcing the release of their private personal information to a third party under a case that on the surface lacks standing or at least very questionable.

The range could be directed to e-mail and or post notice to range users/members/competitors of the case and hold a public meeting.

Many other options exist other than stripping privacy rights of countless individual citizens under the color of law...

what a terrible decision by this judge! Im no lawyer but I assume his demand for this info can be appealed before any info is given over to the turds
 
We can talk about this all day long but the fact still remains, this is costing a lot of money and from what I am reading can/will be devastating to this family owned business. Whether they win or not. We see more and more of our "judges" making incorrect decisions these days. Just the mear fact this is in court where the cost alone can shut down this gun range is an attack on the 2nd. The judge doesn't have to make a ruling. All he has to do is drag it through the courts until the owners can no longer fight it and they are through. Everyone on this forum that owns a gun needs to donate. Even if its just a dollar.

And I am curious...where's the NRA on this one?
 
I hate to hear this stuff.
We've lost so many outdoor ranges and places to shoot over the last 50 years.

Just this weekend we had a big Glock match at River Bend.
I heard many people complaining about how there's no place to shoot outside, anywhere, anymore.
Many drove an hour and a half to get there, some much more.

If you live close to an outdoor range count your blessings....
