How do executive orders work?

Executive orders are simply orders to the executive branch instructing it on how to carry out its duties and powers that are granted via the Constitution or statutory law.

Each of Governor Kemp's executive orders during the pandemic is based upon his authority under the Emergency Powers Act in GA. (Title 38 of the OCGA)

If Congress grants the president the power to regulate ammunition imports, then the president may issue regulations on ammunition via executive order, but the president has no power to simply legislate via executive order.

Executive orders may be overturned via legislation, and they are subject to rulings by the courts.

Regarding DACA, the SCOTUS didn't rule that President Trump couldn't end DACA. In fact, the court never ruled on the merits. They ruled that the Trump Administration didn't follow the procedures established by the Administrative Procedures Act.

Executive orders in and of themselves are Unconstitutional. Presidents do them and then wait for somebody to challenge them. Ultimately Biden is not the real prob future Pres Cammella is.
 
An Executive Order can only be give to a existing branch of our Gov't. It cannot make a new law, that is left up to the executive branch House, Senate, President. If an E.O. oversteps it bounds that is where the House (but we know that isn't going to happen) or Senate is to step in, and also the Supreme Court has the right to step in and stop an illegal EO. Think back to when O Bummer was elected for his second term and before he took office for his reelection He said he has a pin and a phone to do what he wanted to on gun rights. If I remember right it was Sen Tom Cotton told him to go ahead and make his call and write his EO and his impeachment papers would be on his desk the next day. He never said another thing about using EO's like that again. I'm just as pi$$e& anyone else but we have got to let this play out in the courts and if that does not work then we proceed in a different direction. That direction is yet to be determined.
