“To regulate the importation, manufacture, possession, sale or transfer of assault weapons, and for other purposes.” GUESS WHAT THE OTHER PURPOSES ARE? HELLOOOOO MCFLYYY!


SECTION 1. SHORT TITLE.

This Act may be cited as the “Assault Weapons Ban of 2018”.

SEC. 2. DEFINITIONS.


(a) In General.—Section 921(a) of title 18, United States Code, is amended—

(1) by inserting after paragraph (29) the following:


“(30) The term ‘semiautomatic pistol’ means any repeating pistol that—

“(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

requires a separate pull of the trigger to fire each cartridge.

(a) In General.—Section 921(a) of title 18, United States Code, is amended—

(1) by inserting after paragraph (29) the following:


“(30) The term ‘semiautomatic pistol’ means any repeating pistol that—

“(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

“(B) requires a separate pull of the trigger to fire each cartridge.

“(31) The term ‘semiautomatic shotgun’ means any repeating shotgun that—

“(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

“(B) requires a separate pull of the trigger to fire each cartridge.”; and

(2) by adding at the end the following:


“(36) The term ‘semiautomatic assault weapon’ means any of the following, regardless of country of manufacture or caliber of ammunition accepted:

“(A) A semiautomatic rifle that has the capacity to accept a detachable magazine and any one of the following:

“(i) A pistol grip.

“(ii) A forward grip.

“(iii) A folding, telescoping, or detachable stock.

“(iv) A grenade launcher or rocket launcher.

“(v) A barrel shroud.

“(vi) A threaded barrel.

The supremacy clause

Thank GOD for Article 6 Paragraph 2. They will never be law because the 2ND Amendment is a RIGHT! "Why does a judge swear to discharge his duties agreeably to the Constitution of the United States if that Constitution forms no rule for his government? if it is closed upon him and cannot be inspected by him? If such be the real state of things, this is worse than solemn mockery. To prescribe or to take this oath becomes equally a crime. It is also not entirely unworthy of observation that, in declaring what shall be the supreme law of the land, the Constitution itself is first mentioned, and not the laws of the United States generally, but those only which shall be made in pursuance of the Constitution, have that rank. Thus, the particular phraseology of the Constitution of the United States confirms and strengthens the principle, supposed to be essential to all written Constitutions, that a law repugnant to the Constitution is void, and that courts, as well as other departments, are bound by that instrument. With all due respect to the OP for his time on this initial post, there is an error on the page in the Congressional Record (p. H1266) with respect to the authorizing Article and Section of the US Constitution. The proper way to cite the US Constitution is Article, then Section. In this case, the two numbers have been reversed. I checked the same section on a few bills preceeding 5087 and a few bills following it. This bill is the only one with a non-standard cite of the correct Article and Section: Article 1, Section 8. Who knows whether that was intentional or accidental on the part of the democratic sponsor, the Congressional Record or at some other point. That error should not raise this bill to being a part of any great complicated plan on the Dems' part to subvert our Second Amendment rights.

It is clear that their intent is to disarm America and the upswelling of support around the Parkland incident is concerning. I doubt that this bill or one substantially like it, could pass the Congress and be signed into law at this time. Will they stop? No, and we should all remain vigilant.
