    “To regulate the importation, manufacture, possession, sale or transfer of assault weapons, and for other purposes.” GUESS WHAT THE OTHER PURPOSES ARE? HELLOOOOO MCFLYYY!


    SECTION 1. SHORT TITLE.

    This Act may be cited as the “Assault Weapons Ban of 2018”.

    SEC. 2. DEFINITIONS.


    (a) In General.—Section 921(a) of title 18, United States Code, is amended—

    (1) by inserting after paragraph (29) the following:


    “(30) The term ‘semiautomatic pistol’ means any repeating pistol that—

    “(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

    requires a separate pull of the trigger to fire each cartridge.

    (a) In General.—Section 921(a) of title 18, United States Code, is amended—

    (1) by inserting after paragraph (29) the following:


    “(30) The term ‘semiautomatic pistol’ means any repeating pistol that—

    “(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

    “(B) requires a separate pull of the trigger to fire each cartridge.

    “(31) The term ‘semiautomatic shotgun’ means any repeating shotgun that—

    “(A) utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and

    “(B) requires a separate pull of the trigger to fire each cartridge.”; and

    (2) by adding at the end the following:


    “(36) The term ‘semiautomatic assault weapon’ means any of the following, regardless of country of manufacture or caliber of ammunition accepted:

    “(A) A semiautomatic rifle that has the capacity to accept a detachable magazine and any one of the following:

    “(i) A pistol grip.

    “(ii) A forward grip.

    “(iii) A folding, telescoping, or detachable stock.

    “(iv) A grenade launcher or rocket launcher.

    “(v) A barrel shroud.

    “(vi) A threaded barrel.

    American Jurisprudence Book 16: Constitution Law Section 16Am Jur 2d:

    16Am Jur 2d., Sec. 97:

    “Then a constitution should receive a literal interpretation in favor of the Citizen, is especially true, with respect to those provisions which were designed to safeguard the liberty and security of the Citizen in regard to person and property.” Bary v. United States - 273 US 128

    “Any constitutional provision intended to confer a benefit should be liberally construed in favor in the clearly intended and expressly designated beneficiary”

    SEC. 8. SEVERABILITY.

    If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of such provision or amendment to any person or circumstance shall not be affected thereby.

    The supremacy clause

    All debts contracted and engagements entered into, before the adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.

    This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary is notwithstanding.



    “I marvel that the common men are so soon removed from our forefathers that called you into freedom with the supreme law of the constitution of the United States of America unto another LAW: Which is not another; but there be some that trouble you, and would pervert the Enalible rights granted by GOD which was given to our forefathers.

    But though we, or a Judge from the supreme court, proclaim any other Law unto you than that which we have been given in the constitution for you, let him be accused of treason.

    As the founding fathers of this great country said before, so say I now again, if any law to come in conflict would be nell and void of law. it would bare no power to enforce, in would bare no obligation to obey, it would purport to settle as if it had never existed, for the unconstitutionality would date from the enactment of such a law, not from the date so branded in an open court of law, no court are bound to uphold it, and no citizens are bond to obey it it operates as a near nullity or a fiction of law” practice any other law unto you than that ye have received, let him be accused of treason!

    Thank GOD for Article 6 Paragraph 2. They will never be law because the 2ND Amendment is a RIGHT! "Why does a judge swear to discharge his duties agreeably to the Constitution of the United States if that Constitution forms no rule for his government? if it is closed upon him and cannot be inspected by him? If such be the real state of things, this is worse than solemn mockery. To prescribe or to take this oath becomes equally a crime. It is also not entirely unworthy of observation that, in declaring what shall be the supreme law of the land, the Constitution itself is first mentioned, and not the laws of the United States generally, but those only which shall be made in pursuance of the Constitution, have that rank. Thus, the particular phraseology of the Constitution of the United States confirms and strengthens the principle, supposed to be essential to all written Constitutions, that a law repugnant to the Constitution is void, and that courts, as well as other departments, are bound by that instrument.     With all due respect to the OP for his time on this initial post, there is an error on the page in the Congressional Record (p. H1266) with respect to the authorizing Article and Section of the US Constitution. The proper way to cite the US Constitution is Article, then Section. In this case, the two numbers have been reversed. I checked the same section on a few bills preceeding 5087 and a few bills following it. This bill is the only one with a non-standard cite of the correct Article and Section: Article 1, Section 8. Who knows whether that was intentional or accidental on the part of the democratic sponsor, the Congressional Record or at some other point. That error should not raise this bill to being a part of any great complicated plan on the Dems' part to subvert our Second Amendment rights.

    It is clear that their intent is to disarm America and the upswelling of support around the Parkland incident is concerning. I doubt that this bill or one substantially like it, could pass the Congress and be signed into law at this time. Will they stop? No, and we should all remain vigilant.
