If somebody in Georgia invented and built a fully automatic weapon that used a fixed, non-detachable magazine holding only 5 rounds (for a total of 6 shots available), this would not be a "machine gun" under our state law.
O.C.G.A. 16-11-121 (2) "Machine gun" means any weapon which shoots or is designed to shoot, automatically, more than six shots, without manual reloading, by a single function of the trigger.
Yet, you can bet that if somebody built such a gun, even from scratch (not merely assembling one here from parts and components that have moved in interstate commerce to get to Georgia), the feds (ATF, U.S. Att'y Office) would consider this a federal felony crime.
