Looks like it does not have the fuse and explosive charge like a typical grenade . So , yes . The gas in the grenade is not the illegal part . The charge used to set of the grenade , flashbang or gas charge is. Which is why they are regulated

I seem to recall, and am vague on the details, of an event at a North ATL Trade Center Eastman show where one was erroneously detonated, maybe it was CS rubber ball grenade

Look at the top. That is the same kind of fuse as a standard grenade which makes it in NFA item. Notice this fuse does not look like the one the OP pictured? They removed it and put a pull string type device that is non explosive.

No problem. Just be careful with CS gas. I learned the hard way. I blooped one out of a 32mm launcher one time. Damn wind changed direction and got me. Never again with that damn ****. Id rather have my nuts caught in a bear trap.
