no serial number?

    Hi All, i have a friend that has ground off the serial number on a hipoint jhp 40. he did so to put an after market laser rail instead of the hipoint clamp mount because hipoints rails are smaller than standard picatinny. my question is, does that make it illeagel to own? he says no aslong as he gives them the box. he has the box with the serial number, but how could he sell it? thanks for any help.

    It's scrap metal now, well it was scrap metal before too but it's really scrap metal now. Your friend would be wise to break up the frame and scrap it.

    It is illegal to erase or deface the serial number. Your friend needs to turn that thing in before he gets in trouble. The box is not part of the gun.

    There is a legal method you can go through to have a serial number re-engraved, or moved to another part of the gun. Many custom gunsmiths have done this to relocate serial numbers on Browning Hi-Powers where the serial number was on the front strap from the factory. Your friend will not be able to do this because he cannot proves what the original serial number was. A receipt or box is not proof.

    Tell him that since he thinks he knows better, and his gun is still legal, he should call the nearest ATF office and ask them.

    Not only can he not sell it, he cannot own it. Even if he gets rid of it, he has already committed the Federal crime. Getting rid of the gun is just getting rid of the evidence. Destroying the gun could be viewed as destruction of evidence.
