Right but they couldn't arrest 10 million people.

Here's the thing: they don't need to. They just need to arrest a few and make good examples out of them.... just like they are doing here. They've arrested one and 50 people are vowing to never set foot in the state. Misguided, yes, but they are accomplishing their perceived mission.

Pleading to lesser charges is probably going to be his best bet. Everything needs to be in writing and checked out first as others have said.

I will say this though. Did he really need lights/wipers on or had it just started misting? If weather conditions were not bad enough to legally require the use of lights and windshield wipers then I would think everything after could be argued to be fruit of the poisonous tree and therefore inadmissible.
Stopping someone from out of state for not using there wipers and then searching the car for contraband. Really?

You may know this (prolly do) but you always have to look at sec. 11c on the 4473, "exceptions" on the 4473 pg2, state & municipal misdemeanors that carry a (2) year sentence or less do not meet the federal definition of disqualifying "felony".
