Question about class 3 legality

Just outta curiosity, if he bought it before the Hughes amendment went into effect would it change it? He says 30 some odd years so he could've got it before all that happened when no one would've even batted an eye.

Doesn't matter. If he'd built it back then and registered it that's one thing (still an SOT issue I think). No way it could be legally registered today though, and there's no grandfather clause.

You need to get rid of those parts. Probably want to turn them in to the cops and get a receipt, now that his ownership is public.
 
Forgot to add that it's not a drop in conversion. It takes machining and fitting. Interesting read though.

Kind of a grey area there (what isn't). The ATF says that it can't be easily convertible. That's why most open-bolt guns were nixed... Too easy to change to full-auto.

Still, with the parts and the instructions they could easily charge you with 'constructive intent', which they have charged people with and succeeded.

They could (successfully) argue that with those parts and common tools you could manufacture a MG. And since you had step by step instructions along with that, you intended to do so even if you never actually did.

Since there's nothing legal you can do with that 'kit', the best bet would be to dispose of it in a legally documented way. Turn it in to the cops, the ATF or transfer it to someone who can own it (SOT, someone with a registered version of the same gun, etc) and get a receipt.

It's nothing but a potential prison sentence right now, especially since you discussed it on a forum that definitely (from what I understand) has been monitored by the ATF in the past, and probably is now as well.
