I'd like to think I'm not shooting the second time, but I'm having a hard time wrapping my head around not having dumped my mag the first time, sooo...

Self Defense Law Question

If I can see his hands are empty,he is not a threat. I would advance to cover, call 911 and hold position until "first" responders arrive.
Pick up that bat and whoop his azz
1. I would have kept shooting till threat was neutralized.
2. Failing that would have stayed on target and shot as he turned and threw weapon at me thus re engaging.
3. In your scenario, with the facts as they are, the thrown weapon out of the picture, I probably would not shoot again as long as no more threatening moves were made. If it looked like the guy was even considering it and was mobile enough to be a threat I would finish it with a clear conscience.
4. If possible would be retreating to cover while checking for secondary threats and any video surveillance while keeping eye on aggressor.

How am I sure I hit him twice if he just 'winces'?
And I'm not going to be 'shooting at' someone coming at me with a weapon- I'll be shooting into them.

Bat or knife. Separate issues. A Knife is legally a threat inside of 21 feet. A bat is not
A bat isn't considered a deadly weapon?
I have no problem backing away slowly. Which is what I would do in that situation. Defensive doesn't have to be destructive.
