Many concepts have been discussed, some will not make it into the bill. I do not know for sure what made it, as changes are made continuously up until filing. I am fairly confident the bill:
1. Removes bars and churches from off limits list.
2. Enables college campus carry in general for licensees, but possibly with exceptions for certain locations on campuses.
3. Eases restrictions on government buildings to some extent (this one is a moving target, as one might expect).
4. Eliminates fingerprints for renewals.
5. Provides for state legislative preemption of all local regulation of weapons (i.e., not just firearms).
6. Explicitly says nonsecure areas of airports are not off limits for license holders.
7. Requires mental health checks for all licenses (new and renewal) and puts 30-day time limit on check (same as criminal background check).
8. Clarifies that only involuntary mental health hospitalizations are of interest.
9. Clarifies that a revocation of a GWL is not a lifetime prohibition against getting one again.
10. Clarifies that things that are not really convictions do not count as convictions for criminal background checks.
It may do some other things, but I am less confident about them being in there, so I will not list them for now.
I am cognizant that last minute drafting inevitably leads to problems. We will want to move quickly to catalog what we see as problems and try to get them fixed. Bear in mind, however, that what some might see as a "problem," the powers that be might see as necessary for bill passage. In any event, I would appreciate being apprised of issues with the bill, so that I can address them. I may not be able to follow this thread every day (or every hour) for the rest of the session. Do not assume, therefore, that posting an issue here means I have seen it.
A ranking House Republican on Thursday proposed this year’s most comprehensive gun bill to date, suggesting firearms should be allowed without restrictions in the state’s churches and bars.
A bill co-sponsored by House Rules Chairman John Meadows, R-Calhoun, also would allow weapons within some restricted areas on college campuses and in school safety zones - but only with explicit permission from a school official or institution.
House Bill 512 faces a steep climb toward passage, however.
item#7 how is the mental health screen accomplished?
Oh, its a full psyche exam!
Just kidding, no this is checking the mental health records, but containing a presumption that they are clean and issuing the license within 30 days with an opportunity for revocation if something negative turns up outside the 30 days.
Under current law, there are 2 things, one, it is for more than involuntary hospitalizations, and two, the check takes as long as it takes and under prior case law the way the statute is structured this can take for however long it takes. This approach uses a Utah style language to change the law from the way it was worded previously and make sure the license issues.
This all assumes no changes were made at the last minute.
