Senators Ginn, Staton Kill SB 101 with help from Lt. Gov Cagle

The mental health check is a background check to see if you have been involuntarily hospitalized. If you have been involuntarily hospitalized, then you are federally prohibited from possessing a firearm.

The mental health check is not you going to a Doctor for a Psych exam.
 
OK I have the bill but it's in an Adobe file. Once I figure out how to post it I will. I tried to copy it but the underline and strike through didn't show up.
 
So would it just add permit holders to 16-11-130? That'd make me feel less special as a military member, but I can live with that lol.

That's what I was asking earlier. If they're basically added to 16-11-130, that's freaking huge. It would require a little rewriting of current law, since 16-11-130 also completely exempts certain people from having to get a permit in the first place, but I think that'd be a great move forward.

Yeah...no.

"who has been adjudicated as a mental defective or has been committed to any mental institution;" - ATF

A person can be involuntarily hospitalized for observation (emergency hospitalization for evaluation) without being committed to an institution or adjudicated as defective.
