Would be kind of hard for them to prove which contact was an "accident" versus "situational" IMO

It always was... The only folks that really had to worry before were the YouTubers and such who take pics of themselves shooting one in an 'illegal' manner. That's still probably the case if you upload a video extolling the benefits of a brace instead of an SBR stamp, brag on how you 'got around' the ATF by using a brace instead, and show yourself shooting it from the shoulder when the 'situation' didn't require it.
