CCW clearly stated that the buyer asked him about round count (insinuating the buyer has full knowledge the gun is not "NIB") and that he never saw the option to choose "new" or "used". He is also clearly stating that he will stand behind his gun and will "go a mile to make it right", which I assume means doing whatever it takes to placate the buyer, should he have a problem once the gun is received.
I can understand the wadded panties if there was intent to mislead, but that's not what happened here?
