Check the battery cables first, if not tight to the terminals or if acid from the old battery corroded them inside the insulation you could have an intermittent short, which is what this sounds like.

Could be, I'll take a pic if that helps, their was a lot of acid around the negative cable

Yup it's the starter, cleaned the corrision off the battery cables and nothing. Probanly buy some new ones while I'm at it.
