The case referred to by Albatros43 is ABRAMSKI v. UNITED STATES, and the defendant DID buy the gun for his uncle. But what he was convicted for was lying on the Form 4473; it was not the straw purchase. Read the decision and you will find that the Supreme Court expressly says that a straw purchase IS NOT illegal. Lying on the form 4473 is illegal. There is a strong dissent in this case that lying about a legal act is not a crime.

The reasoning in this case is really strained, and it is a very results oriented decision (as opposed to being decided on pure legal principles).

I remember when the "straw purchase? law went "on the books". I was told that buying a firearm as a gift was a straw purchase. Through the years I've come to realize that is not the case.
