Trespassers on Private Property

It's obvious to me from the posts what the general consensus is. You need to lay land minds around your perimeter wall, claymores at all pedestrian entrances and machine gun towers at all perimeter corners. The ODT has sound advice once again!!!!
Bouncing Betty's would be better, the Claymores have C4 that would be good for cooking~!
 
Being armed in this situation is warranted and prudent. I would never even pull a weapon unless there is a threat. You were there, so I won't second guess you. I would not try to stop someone for driving up my drive, especially if they were in the act of leaving the property. Taking a picture of them, and making sure they know you are doing it, is a good move. If they are going to do bad things, they won't want someone easily able to ID them to the authorities. I would have called the police right afterward and let them decide how they wanted to handle it. I've had to call them before when they decided it was a non-incident. They thanked me and told me they appreciated it.

On the second incident, I would have done the same as you. Catching someone in the act and detaining them is not out of bounds. I'm glad you did not have to fire and did not fire a warning shot. That would have changed the legal formula.
 
A Captain I know fairly well has the same answer for everything I ask him about.
Call 911.

Seriously, that's always his answer, don't even try to sort it out, just dial 911.
 
My fault for not giving a complete answer.

You still need permission to hunt (or fish) on land you don't own, but if it is not posted, oral permission is fine. Probably 90 -99% of the deer hunting in Georgia occurs on land where the hunter only has oral permission.

Funny story here about that. We caught a couple of fellows turkey hunting on our deer lease. They claimed they had permission, and I asked them who gave that permission. One of them popped off right away, "gh1950". so I ask him "so what does he look like?" Course he didn't know, and we escorted them off the property. But it was fun moment.

The corollary to this, is that you see questions on interweb forums all the time about " there's this tract of land that is owned by ????. is it o.k. for me to hunt it. The short answer to all those questions, is that if you don't have express permission from the owner, it's not o.k.

I wouldnt shoot them, just have them get out of their vehicle for my safety, and hold them till the cops came. only way i would ever shoot anybody is if they made me feel threatened for my life.
I would make sure that I have ample light on them before asking them to exit a vehicle and giving them room to shoot and move
 
@gh1950 & GeauxLSU GeauxLSU - Here in Forsyth county back in the 70's & 80's there were plenty of places to hunt around my house, nowadays not so much.

Now using #1 above with the stipulation that it's not posted, that would change things for me - maybe. I never understood that if it wasn't posted it was ok to hunt. I guess I never read much past written permission....

I'm just checking with you both, I know GeauxLSU personally and I know he keeps up with things better than me and gh1950 do you have anywhere I can see this in writing? I'm too old to get in trouble :becky:, but this could be a BIG difference for me.

Here is the law. http://law.justia.com/codes/georgia/2010/title-27/chapter-3/article-1/part-1/27-3-1 Now what it states, obviously, is that the land must be posted AND... the land owner (or lessee or hunting rights lessee) must also inform law enforcement that hunting rights must be in writing. So, you can read this from the landowner's perspective or the hunter's perspective. I assumed we were talking about it from the hunter's perspective. If Im hunting land I don't own, (and I'm not with the landowner while hunting) I'd be sure and have written permission. That way you don't need to worry about what conversations may or may not have been had nor what the current posting status is.
 
No one is saying that there is "no such thing as criminal trespassing." What I am saying is that driving down a drive way with no gate on it is not "it."
dont leave a place when they tell you to and see what ole LEO charges yor ass with,yep criminal trespass.
