I think it's a good shoot, and the shooter went "the extra mile" to avoid using his gun. He did way more hand-to-hand grappling than I would have before escalating to a kick to the balls, to the knee, or just shooting him.
I also think that THIS would have been one of the rare situations where a "warning shot" into the ceiling or floor would have been good tactics and legally justifiable. It could have had the effect of slapping a dose of reality into the face of the drunk bully and cause him to realize how close he is to losing his life.
The shooter/ defender put up with the attacker's crap for a long time, and had his gun holstered and held at low ready for a long time, so what "tactical advantage" would he give up spending a half-second and giving up one round of ammo to make a very loud noise and try, one last time, to get the other dude to stop attacking him?
All that being said, I feel the same way about this dead drunk dude as I do about Michael Brown in Ferguson, MO.
He was being an a-hole and bullying / assaulting others, and now he's dead, and he won't be a problem for society anymore. If he really wanted to live a long and healthy life, he'd have used some self-control and do his ranting and attacking from behind a computer monitor!!
