What is the law on shipping C&R from individual to individual?

What is the law on shipping C&R from individual to individual? Neither with a C&R license. Does it have to go to a FFL? Please post a link to the law stating how the weapon has to be transferred.

I bought a Colt 1903 pistol from a guy out of state. He wants to send to my FFL, which is fine, just wondering what the actual law is, since it's C&R.

Except for antiques, out of state firearm sales, modern or C&R, must go through a licensed individual. A non-licensed seller can send to your FFL, if he agrees to accept it, by simply including a copy of their DL.

C&R are 50+ year old guns made after 189? I think. A c&r gun can be shipped direct to a c&r license holder, if state laws permit which they usually do.

Since you are not a type 3 FFL (C&R) and the firearm is not an "antique" (means any firearm not intended or redesigned for using rim fire or conventional center fire ignition with fixed ammunition and manufactured in or before 1898 (including any matchlock, flintlock, percussion cap or similar type of ignition system or replica thereof, whether actually manufactured before or after the year 1898) and also any firearm using fixed ammunition manufactured in or before 1898, for which ammunition is no longer manufactured in the United States and is not readily available in the ordinary channels of commercial trade."

This is the law that you're looking for:


(3)
for any person, other than a licensed importer, licensed manufacturer, licensed dealer, or licensed collector to transport into or receive in the State where he resides (or if the person is a corporation or other business entity, the State where it maintains a place of business) any firearm purchased or otherwise obtained by such person outside that State, except that this paragraph (A) shall not preclude any person who lawfully acquires a firearm by bequest or intestate succession in a State other than his State of residence from transporting the firearm into or receiving it in that State, if it is lawful for such person to purchase or possess such firearm in that State, (B) shall not apply to the transportation or receipt of a firearm obtained in conformity with subsection (b)(3) of this section, and (C) shall not apply to the transportation of any firearm acquired in any State prior to the effective date of this chapter;
