What would you do, I discharged my weapon on the way to work this A.M.

Came across a deer this morning with her back end broken down and some serious road rash on her head sitting in the middle of the road. Pretty rural area ,but several houses were visible. Allowed it to pull itself from the road and dispatched it on the roadside. I am sure I violated some law,but if it happened again tomorrow I would probably do the same thing. The anemic 380 to the back of her head was very humane, ( Buffalo Bore +P ) hardly moved after being shot. Forgot about the G36 inthe glove box.

I would have done the same as you. I had one get hit in front of my house once, and went to cut its throat to put it out of it's misery, and all the neighbor women were screaming to take it to the vet they would save it.

45 minutes later the cops showed up, and shot it. It was horrible the neighborhood women wouldn't let me put it out of it's misery.

Probably did break some law, but it was the humane thing to do. Maybe some of the LE/DNR folks will way in on this one......shooting deer out of season?.....discharging near residence?

I have done the same thing a few times. Down here no one thinks twice about it.

O.C.G.A. § 16-11-103
Discharge of gun or pistol near public highway or street

A person is guilty of a misdemeanor when, without legal justification, he discharges a gun or pistol on or within 50 yards of a public highway or street.

I am almost positive putting an animal down -- no matter how proper -- is not considered "legal justification" for a common citizen.

However; You did the right thing even if it was not the legal thing.

You have to remember this though. If you do it, the officer will not have to fill out paperwork why he had to discharge his weapon.

did the same thing but was in a rich area neighborhood. People were screaming trying to call this person or that to pick her up. thought a pistol would be wrong timing so i came out with a knife and did it. she had been suffering for almost half an hour with 4 broke legs and labored breathing. after she went, pulled her off to the side and waited for the police since everyone was "calling to turn me in". officer shook my hand and told me it woulda been fine to shoot her in his book.
