Simple fix, put that farkin thing back where it was. Plus I think there is a certain height requirement according to code.

Code don't apply to homeowners that occupy the house. Only to builders and landlords.

Leave the stained rail where you like it. Put up another unstained rail in the exact position the first one was in. She has her's and you have yours. Your's will be nicer. Or put the house up for sale (that will show her) and buy a house with no stairs.
