Depends on the specifics of the trust language as to whether or not the trust may or may not continue upon death of the grantor. That's often an overlooked consideration.
You can put them in the trust. As to should you or not, well, I'm kinda squeamish about pitting non-NFA items in NFA a trust; ATF can get visibility of the non-NFA items if you subsequently add another NFA item to the trust. Maybe I'm a tad paranoid or just being careful.
If you have NFA items, placing them in trust can make passing the items to named beneficiaries much easier than through probate as you can use Form 5s for transfers rather than Form 4s, if the trust is properly written. Saves a lot of hassles and cost of tax stamp(s).
I greatly appreciate JoKeR50 and his endorsement. I am sure that any of the attorneys that are mentioned in this thread will treat ODT'ers right. Dean and Neal are well known and offer a product at an unbelievable price in my view. If you do make the investment in the Class III world...
I'm gonna say double tax stamps as you then have an AOW--shotgun w/ less than 18" bbl. One stamp for the lower, one for the AOW. Best bet is to call ATF and get definitive guidance.
I always suggest at least one successor trustee--gives another named individual in the trust an opportunity to play with the toys without worrying about "constructive possession" issues. For the ODT'ers that know me, they know I'm a trust attorney and like heavyd says, little nuances make all...
The initial County reference is typically to the County in which the document was signed. So, a Fulton resident may execute a trust reflecting he's a Fulton resident, but if the document was signed in DeKalb, it should read State of GA, County of DeKalb.
A Georgia Notary is able to notarize...
did you identify another trustee in your trust? worst case leave it w/ that person. if you didn't ID another trustee, get an attorney to help you make a legitimate change to the existing trust. if you did a Quicken trust or some other fill-in-the-blank type of trust, you're about to learn a...
uh, be careful guys--the State AG's office doesn't regulate the unlicensed practice of law; that is done by the State Bar of Georgia. Make sure whoever is doing it has been cleared by the State Bar, not the State AG. There are several local GA lawyers that can assist or people can always...
