I just got off the phone with a salesman at Alexander's who implied that he would fight me when I came in the store again simply because I was stating factual law to him. My GF tried to purchase a Shield during their Saturday sale and came back delayed, he said the firearm couldn't be picked up for 5 days, FBI. gov begs to differ, it's 3 days. In his defense I did call him an idiot (that's when he threatened me), but if you don't know the gun laws you should not be behind the counter. I did speak to a manager after this and he apologized for the guys behavior and said that he would still honor the sale price and no tax, but stood behind the guys statement of 5 days if "no resolution". I know one monkey doesn't stop the show, but my money will not go into their register. My GF does intend to go ahead with the purchase, but we won't be back.

Overreaction or no?
 
I have purchased there many times..When has a wait period started??I know nothing about that..
Every so often a delay will come up after so many guns called in or if someone has close to the same name as the buyer, it's not unusual for it to happen. It happened to my wife before she got her license.
 
The way I understand it, the minimum is 3 days, but the burden falls on the store at that point. Meaning a gun store can refuse to sell to you or they can make up their own 5 day time line. My question has always been, If in 3 days nothing comes back, the store sells the gun and then they get a "NO" or a crime is committed with the gun by someone that should have never had it, can the gun store be held liable. I've never gotten a straight answer from a store owner or the ATF.

I'm not sure why a store owner would risk it.

I believe some stores has it set up that until it clears or drops out of their computer that they can't sell it to anyone else either until they contact you. Some of those times are up to 30 days. But that may just be the big box stores systems only. The Mom and Pop stores are a lot different, like Cherokee Pawn and others.

I can see that point, but both guys stated it as law and the law says 3 business days. If it had been stated as store policy then no harm, no foul.
