Below is a blog post that just went up on our website, linked below. You can download a free amendment that keeps your co-trustees from having to deal with the 41F requirements.

New 41F Update for all NFA Lawyers Clients:

The ATF will require fingerprints, pictures, and a law enforcement notification for all NFA applications postage marked on or after July 13, 2016. Only you, the creator (settlor) of the trust, must comply with these requirements if you follow the instructions below. The amendment and instructions below apply only to trusts drafted by NFA Lawyers, LLC.

- Download and complete this Amendment
- Get fingerprinted at your local gun shop or
detention center
- Obtain passport pictures from your local gun shop
or drug store
- Take the following to your dealer when you
purchase an NFA weapon

1) A copy of your entire Gun Trust and a blank
Assignment of Property
2) A copy of the Amendment you downloaded and
completed
3) Fingerprints
4) Passport pictures

- Your dealer will help you fill out any forms. Most dealers also mail any forms for you.

You may shred this amendment upon approval of the NFA application. At this moment, all co-trustees are back on your trust and may possess all NFA weapons in the trust.

If submitting a Form 1 or Form 4 without a dealer, you must mail all of the above requirements to the ATF. A Form 5320.23 and a copy of the Form 1 or Form 4 must also be mailed to your local chief law enforcement officer (CLEO). This person is your local sheriff or constable. Regular mail is perfectly acceptable.

I filed my trust (with you) and paid for my supressor about a month ago (QRF), do i need to do anything regarding 41F?

No, Sir, you do not for that application. Our trust is 41F compliant.

For applications sent in July 13th going forward, simply follow our instructions on the link in my OP.

I have a question, I was pushing to buy a suppressor and sbr and was recently told that regardless, if I purchased an NFA item after July 13, regardless of what I had done previously, I would have to all the stuff anyway with any new purchase.......
I'm naive to all the registration regs and just want to set stuff up where my wife and kids can inherit my toys when I pass. The idea of fingerprinting a five year old and eleven year old is not appealing to me. Can you clarify? I have no issue getting all the stuff up on me but it is not possible at the moment to round the whole family up and go to the jail for printing.

Sure. Your co-trustees will not have to be fingerprinted or send in pictures. The amendment on my website takes them off as co-trustees and you add them right back on by shredding the amendment.

The end result on July 13th is this: You fill out an extra amendment, submit only your fingerprints and picture, the dealer sends everything off. It's just extra paperwork.
