1. Grandstanding. It's an election year, gotta apeal to the base "We tried everything we could to ban those mean, old guns"

If the court rules that braces are stocks then the only legal thing a person can do is to register them as SBRs or make them "long enough"; i.e. add longer muzzle devices or replace the barrels. In some cases the brace can be removed and it could stay a legal pistol.

Actually on 06 January the U.S. 5th Circuit Court of Appeals ruled that the BATF did not have authority under law to ban bump stocks. I'm no attorney, but unless the Supreme Court hears the case I think that means bump stocks are legal...
