Buying an SBR from an Individual

I am leaning toward going the form 4 route.

Gandalf says anything less than 16” rifle and 18” shotgun (note they’re different) or overall length less than 26” (I’m typing that from memory I may be wrong) or a stock attached to a pistol these all constitute an SBR, note atf measures barrel length from the face of the chamber to the end of the barrel or permanently attached device at the end of the barrel

What is quick?

Straight to ATF with form 4.... YES......(if you read the forms and follow the directions on the form it tells you exactly what to do and what to put, if you cant do that easily there are multiple step by step youtube videos where they fill out the form as you watch and follow along.
You do NOT need to utilize a dealer to facilitate transfer UNLESS its across state lines
No, it is not faster to become an FFL than to do a form 1, 3, or 4
Yes, Paper forms do take longer but its actually been very quick since the paper examiners have been freed up.

Most people that do individual to individual (an individual includes a trust just fyi, aka the trust is the owner) and pay half up front as earnest money, and take the un-serialized portion of the firearm as collateral. Please feel free to continue asking questions as I'm reading a lot of poor advice lol

Form 3 = dealer to dealer
Form 4 = purchasing from individual/dealer

You know as well as I do there is no such thing as quick in the world of ATF but this is probably the fastest approval times since I can remember

Not exactly. Without the upper, the lower is no longer a nfa item in its current configuration. Some believe you can sell it that way without an approved nfa transfer application, others contend its still an nfa item despite its configuration not matching the nfa creation application. A dealer won't let you take any piece of it until the transfer is complete. YMMV.

The issue can also come up if you have other ARs at home. Say you only own one rifle length, coming home with an 11" is suspect. But if you own a pistol and rifle lower? Probably good to go.

One thing to note is that nobody to my understanding has been prosecuted for "constructive intent" or possession of an illegal SBR as their FIRST crime. Use one to rob a liquor store, that's a different issue.

I have bought and sold multiple NFA weapons of various types between myself and other private individuals in Georgia --no dealers involved-- but this was back before e-filing was popular and there was a significant wait of several months to a year.

And yes, you as the buyer had to pay for the weapon upfront, submit the transfer form 4, and you couldn't take possession of it from the seller until the form came back approved and stamped.

Same process as doing an SBR. Very simple. Wait times for this currently around 2 months or less.

Sideways move. Wanted smaller so sold the m11/9 and got the baby .380
I Efiled my 380 so my paperwork showed up faster than the buyer’s individual hence I still have both in my possession.

Then converted it to 9mm with a $2400 CFW tungsten bolt and an m11/9 barrel. Uses the same m11/9 magazines.

For kicks got this scarce 71 round Suomi drum modded with a Mac feed tower, haven’t played with it yet..

And finally have this Lage 31k upper just purchased. This my friend’s upper I borrowed for the pic. Haven’t bought my sights, stock or forward grip yet. Takes the unmodified surplus Suomi drums. Awesome WWII drums I must say.

I had the same upper but for the m11/9 and it ripped.

So in the end I get a much more compact package with no negative trade offs aside from the price of the tungsten bolt.
