Diesel in a gas car

My wife was returning from South Florida yesterday and stopped to get gas off the I75 in Gainesville. She went to a Chevron and filled up. When she drove back onto the highway, the car started to sputter out to a stall. Luckily, she was able to get to the side of the road.
Called a tow truck to take it to the dealership. While waiting, one of those ROAD RESCUES showed up and offered assistance. The guy, says your at least the 5th car that has broken down this morning after getting gas at that station.
Fast forward, car is towed to dealership, she gets a rental, and heads back to the gas station to get their information. Of course, the first guy said he didn't understand English. He gets a woman to come out and she explains what happened. Told her to write down her name and contact information and they will pay to fix the issue. THERE WERE OTHERS ALREADY ON THE LIST AND THEY ARE STILL SELLING THE GAS! The guy heads out and is checking the refill tanks and I think he already knew they were ****ed up, and then proceeds to put notes, "OUT OF GAS", all the pumps.
Dealership isn't opening until 7:30 so I'm waiting to call them. I have to either fly ($360 + tax), drive (5.33 hours one way), or have it transported ($560ish) up here Gwinnett county.
I really don't think the gas station will follow thru. I want the rental, repair, lost wages and cost of getting it back home. I don't know how much damage has been done either.
I really dont want to drive down to turn right back around. What's my best course of action? And my next course of action if they refuse to pay?

Can't help you with the legal part except to suggest your consult with a lawyer, maybe one who is located in Florida.

I'd probably get it repaired down there, fly down, and drive it back. That way, if there's anything still going on with the car, you have a chance to take it back to the place that did the repairs. I'd guess this time of year it might not be a speedy process getting anything done.

If you have your insurance pay for it they'll subrogate for the cost of the repairs.
