Why not just point out to him that the fence is not on the property line. Offer to help him move the fence to the property line? If he refused I would seek legal recourse.

At the time he put up the fence did you object? If you were aware he was doing it then would have seemed like a good time to say stop.

I looked out my back door one day and it was up.
I figured it only took maybe an hour since all the post were already up. All he had to do was nail up pre-fab boards.
