I think ATF could, if they wanted to, ban these "80% complete" machine gun conversion kits just because they are obviously intended to make a machinegun out of a semi-auto and have no other purpose. They're designed, marketed, and sold for that purpose, and anybody who buys them has that intent (maybe not to do it right away, but do it later).
 
Remember, one federal court already found (and the ruling upheld by the U.S. Court of Appeals) that a decommissioned machine gun that was capable of being restored in only one day, even a full 8-hour day by a skilled gunsmith in a machine shop, WAS A MACHINE GUN PER THE N.F.A. despite the irrefutable fact that it had not been restored, and nobody attempted to restore it. It was just "too easy" to restore to firing condition.
