Is being here illegally a felony or a misdemeanor or does it even work that way since you are not a citizen? Real question here.
Constitution only applies to citizens.

Some things should not reach the court system. This is one of them. The only right of someone being the country illegally is being treated humanly as they are deported.
Technically misdemeanor on first try, but the illegal immigrant appeasers will remind you it's not criminal. If they are removed and return, then it becomes a felony - another fact always overlooked by illegal immigrant appeasers.
Punishment is similar on the hiring of illegal side. Of course if we increased the penalty to an automatic 10 years on the first offense for hiring an illegal immigrant, the problem (I'm sorry CRIMES) would be solved overnight.
