As long as he has his stamp submitted and nothing is assembled or he doesn't put a stock on his lower I doubt the ATF is going to come knocking. I know of only one case where someone was prosecuted for that and the ATF were looking at him already for other violations.

My thoughts exactly. It's too easy to become paranoid

I agree with the large grey area of the matter. I was just throwing in my 2cents, thats probably not even worth half that.
I seriously doubt the ATF will come knocking but everyone should know the facts just in case.

Thats what I would do. If you dont want to go through the process of building your own lower out you can order a complete lower and Form 1 that. You can still use it with your rifle length upper until you get the stamp..

Alternatively you can order an AR pistol and Form 1 the lower from it and use it as a pistol or with a brace until the stamp comes in and then switch the back end from pistol to a stock.

I built 3 pistols. I have a form1 ready to go, just need a little extra cash. I will not buy an y stock until the stamp is in my hand.
