Seeking info

So I'm buying a mcx legacy lower with a stock and the guy im buying it from is going to ship it to my local FFL with a stock attached I believe. My question is, when I pick it up at my FFL can it be classified as a pistol or a "other" similar to buying a stripped lower, so I can put a brace and attach it to a upper with a barrel shorter then 16"?

Depends on how the FFL processes it. They can actually acquire it as a Rifle, then Dispose it back to themselves as a Receiver.

Also, it’s only a Rifle if it was previously built into a complete rifle. If it left SIG as a Receiver with a stock attached, it was a Receiver; the stock alone doesn’t make it a Rifle. If it left SIG as a Receiver, and no one ever built it into a complete anything, then it’s still a Receiver.

Short answer is, it’s classified as whatever the FFL that handles the transaction Acquires and Disposes it as.

Until you actually look at what the FFL puts in Section 5 of your 4473, anything that any of us say here on ODT is pure conjecture.

Thank you for your input, ill just have to talk to my FFL to really get the final results as far as the classification and what can be done.

Just picked up the lower and my FFL classified it as a Receiver on the 4473, I asked about the classification sine I'm buying it used from a 3rd party and since its unknown how it left SIG as a pistol, rifle or receiver, that they have to file it as a receiver since its "unknown" so technicality I can build it out as either a pistol or rifle. They told me the only way to know its original form is for it to get confiscated by a agency and they call SIG to ask how it left them.

Good to go! That's exactly how we would have Acquired it in our bound book.
