Need legal help for my son

Can Laxguy59 Laxguy59 help here? Just remember him being tagged in threads about attorneys.....

My son is a poor Paramedic and doesn't have a nickels in his pocket. 5 years ago he had a minor incident where he bumped another car. There was no damage to either car, and an accident report was issued.
The other driver has sued him for $14000 for "pain and suffering in a NO DAMAGE accident.
What course of action do we need to follow? Obviously he needs a lawyer, but has no money to secure one. We need to try and get the accident report (if it still exists). He had video of the impact point, but we can't find that video.
If anyone out there can help this poor first responder, his entire family will be grateful.

Depending on the state , but it’s have a time limit on filing , and how did they file in 21 and he’s just now getting served ?

sadly you’re gonna need an attorney for defense .

From reading this post, it looks like this was filed after the statute of limitations was expired. In GA, personal injury lawsuits have a two year statute of limitations. I don’t understand how this was even filed. You can get a free phone consultation with most attorneys. Do that first and go from there.
 
I was in a similar situation as your son, although, my suit was filed within the 2-yr limitations. The bottom line is that your son's insurance company needs to be notified ASAP - this is why they are paid! I know it is a scary process full of unknowns, but the insurance company is on the hook for this, at least initially.

Just to give you some initial peace of mind... Your son is only being sued for $14k, which I would imagine is WELL below your son's insurance limits. So honestly, he really has nothing to worry about in terms of exposure to his personal liability/risk. In my case, the other party tried to sue for 4x my limits, which literally derailed me into a state of anxiety and depression for two years until they finally settled for 10k under my limit.../whew

Things you son can and should be doing in the meanwhile:
  • Buy a folder and file every single document he receives from anyone and everything involving the case. Print out an emails and put them in the folder too.
  • You son should call his insurance company and get the point of contact, most likely a specialized claims adjuster. They can explain the process and keep him updated.

I think there might be some slimy lawyer mumbo jumbo that allows exceptions to the statute of limitations involving injuries that may not be immediately noticed but could be traced back to the accident. But I think an initial claim still needs to be filed. I'm not 100% sure on that...
