New York City can suck a dong

Technically, she is responsible for reading every law ever passed in NY. Realistically, NY is dumb and they're being a-holes in this case.

Read the article. She did what many people would have done as far as due diligence goes while preparing for the trip.

This will probably go away for her with a misdemeanor plea deal. It's all just the DA making noise, and making a name for himself. Look at the boxer he made fun of for the weapons charge right before this. Man just wants to be a sound bite, and incidents like this get people talking about him.

will that make her ineligible to carry even if its a misdemeanor? i am far form a lawyer, i make far to much sense to understand all these crazy new york laws
 
Dude seriously. LAWYERS spend years in school, and have law libraries and clerks, to track the laws in their OWN states. How the **** do you expect anyone to know all of the rules over every state in the union? Seriously...I say this as a former LEO in GA, I could barely keep up with my laws in GA as an officer, so to expect a citizen to know the laws to such a detailed degree?

1) If you're going to type around the censor, don't do it when replying to a mod. We are much less likely to catch it that way ;)

2) A simple google search will tell me that taking an unlicensed handgun to NY state is bad juju...I do not need a lawyer or a LEO to help me with that.
 
Yup...and I did my best to judge the situation at hand and apply my discretion on whether or not I arrested someone. One thing I vehemently despise are robotic, nay despotic, LEO's that have forgotten their primary mission, to serve and protect the people.

Best answer in the thread. Unfortunately, I'd venture a guess that the Ports Authority officers who were dispatched to the scene are not given any officer discretion per departmental policy. I don't know this for sure, but I just feel as if their SOP is "anyone with an unlicensed gun at the airport takes the ride, no exceptions".

That said, good LEO's know that there is the letter of the law and there is the spirit of the law. While this woman broke the letter of the law she certainly made a demonstrably reasonable attempt to be a responsible citizen and obey the spirit of the law. Our entire system is built on the premise of "reasonable"...reasonable doubt, unreasonable search and seizure, reasonable expectation of privacy etc. What is entirely UNreasonable is the assumption by the NY government that everyone with a gun is a criminal. So yeah Fork New York!

Depends on what kind of deal they make. I wouldn't be surprised if they let the whole thing go. They just want the publicity of "hey, we stopped a person carrying a gun, gun control laws work" even though 9 dope mules, 2 people on the watch list, and an actually criminal with a gun rolled thru while we were worrying about the pregnant woman who isn't a threat."
