Personally? I don't think he has a leg to stand on.....

Generally speaking, I think trespassers on railroad property should EXPECT to get run over by trains when they deafen themselves with headphones or earbuds and stare at their feet while they walk along the tracks.

BUT, I also expect train engineers (drivers) to keep a lookout for idiots and take "reasonable" steps to avoid running them over.

If this kid was plainly visible to the train crew 1000 feet away, but they didn't notice him, and didn't blow any horns or ring any bells (sounds he might have heard even over his music), this moron could possibly have kept the use of his legs.

I think railroads owe a duty of care to trespassers to be reasonable in watching where they are going and blow loud warning signals to those morons whenever they are found. If such a warning, even promptly given, isn't enough to save some idiot, well too bad. Life's tough; life's even tougher when you're stupid.

I will say that when you are pulling 15,000 tons of freight at 50mph and you shoot the brakes 1,000ft ain't nothing. Trust me. But when we see anyone on or around the tracks we blow the horn and ring the bell to try and get their attention. You also have to realize that when you are runnin at those speeds and you shoot the brakes like that you have a possibility of derailing because some idiot wants to be bop down the track to lil john with his beats on and ain't payin attention that he is on a live track, blame the engineer/railroad.

I agree. If you need to be warned to avoid a track on which a locomotive might run (travelling as fast as 100 mph and weighing 75+ tons) you really needn't be reproducing so I don't personally have a problem with the train making a pancake out of your ass.

I never said that 1000 feet was enough to stop the train. But 1000 feet can give the pedestrian enough time to get off the damn tracks if the train were to sound the horn.
Seriously, how long would it take for the guy to look over shoulder upon hearing that air horn and then take two quick steps to the left or the right? That's all it would take to save him.
