Ok. If this topic has already been discussed, I apologize. I'm a Boomer, a Fudd, I can drive a standard shift vehicle, back up a truck without using the rear view camera, when I started driving the dimmer switch was on the floor board, I still write checks, I'M OLD!!!
Where do we stand regarding the ATF PISTOL BRACE BAN?
Was at the gun show this weekend and folks were walking around with firearms with braces.
Has it been rescinded, stopped, dropped or whatever?

Nationwide injunction pending final outcome of the case.

This. To keep it simple- the BATFE ruling is still in place BUT the courts have ruled that there is a good chance that it will be revoked/rescinded, and have put the ruling on hold until the court cases have been fully decided (which could be a couple of years). So the rule is still out there, everyone is waiting for the cases to work their way thru the court system, so it is not able to be enforced currently. The first court ruled that the injunction only applied to a couple of groups that were part of the original case, but the second court ruled that the injunction applies to everyone in the US.

so shops are selling braces and pistols with braces again.

“Pistol Stabilizing Brace is an accessory which, when added to a large frame pistol, provides the shooter with an additional point of contact on the forearm, greatly enhancing the control of the host firearm”

They have been stopped from using the published ATF Rule on braces but they are still enforcing the laws regarding firearms as defined in 26 U.S. Code § 5845 (short barreled rifle). I saw a clip on case involving a firearm brace where it’s said they’re not using the previously issued ATF Rule on braces to take action. Their position is that the braced weapon in question has been altered to meet the definition of a firearm under the above section. I can see that happening if one can argue that the weapon has features that are only suitable for firing in a manner consistent with rifles (I.e. peep sights, rifle scopes etc.). Ultimately it will be up the courts to decide. Personally I would not have a braced firearm until the matter is settled by legislation or the courts. I did send my rep a suggestion for a change of the law to include braces in the definition of handguns but getting them to act is going to take pressure from many of us.
