The way I interpret the law, its an SBR, really no debate in my mind... Its a "rifle" (.22LR) cartridge in a weapon with a short barrel and shoulder stock.. Unless you have a pistol, I seriously wouldn't be caught with it in that configuration... As for intent, most Ar owners/builders could be in trouble for one reason or another.. Its a very fine line..... Just my take of course..

Correct, it would be a smooth bore. Which in a pistol would be an AOW. But since it has a stock, it'd be a rifle, which kicks it back to SBR. I'd also imagine that since a SBR is worded 16" or less. There's no stipulation on minimum barrel length.
 
Right, but I think the kit will get pushed out if the way by the hammer before the hammer hits the firing pin. Without the chamber the kit will probably not be aligned perfectly. Too far forward or too far back and the hammer pushes the whole thing forward without ever contacting the firing pin.

I wouldn't want to rely on that. It doesn't take much of a "bounce" to set off a .22. Just the inertia of the firing pin flopping around will do it sometimes.

And as to the original point, I doubt the ATF would care whether it would fire to classify it as a SBR or an AOW. They don't care whether a gun will fire full auto as long as it has holes in certain places or certain parts, it is a MG.
