Veteran - Presumptive Claims

Thanks for your response. As I learn more and more about the VA the more and more I realize I still know nothing.

I should have been more clear. I am looking for a vet that has filed a claim for a presumptive disability with regard to chemical exposure (JP5 or AFFF) and immune disorders.

I brought up presumptive disability to my local VA rep and after several minutes of back and forth he said I was not eligible due to particular immune disorder I had. He subsequently called the next day and advised he misspoke.

JP5 exposure is an open and closed case and you should be rated accordingly. My employee in my civ job is 20 year retired AF and got recently rated, 20 years after the fact, for fuel / chemical exposure. Any kind of chemical, smoke, or environmental exposures are pretty cut and dry for the VA. You just have to navigate the VA system and wait a while for your rating unfortunately.

So I was wrong about 10% being max for hearing loss/tinnitus. Good to know. I should say misinformed since that is what they told me.

Partially wrong. Max 10% for tinnitus, but if you have further hearing loss they’ll rate you separately on the amount of loss. I got hearing aids and was given a total of 20%. 10% for tinnitus and 10% for hearing loss.

At this point per the VA I will not be eligible for any type of back pay/compensation for any disability due to the type of discharge. I took an “early out” with a lump sum payment. I will have to pay back the monies prior to getting any future compensation. I am not looking for compensation just help with my medical issue.

That explains it. For some reason when they filed my claim it was for Tinnitus only. Even though they gave me hearing aids. I gave them back. Couldn't stand hearing all that crap.

Dude that early out payment is such a scam. Once you’re rated you’ll be allowed to receive medical treatment. You just won’t receive retirement compensation until your debt is paid back.
 
I have been out for @ 32 years. This immune issue showed up @ 2 years ago initially effecting my upper body muscles. Than my eyes. Then my leg muscles.

I have 4 doctors, who have diagnosed me with this disorder are aware of possible causation (long term exposure) but will not give that as the reason for the illness. All 4 doctors have rated me with a permanent disability from the disorder.

Military service was one of the best experiences in my life. The early out was also one of the best decisions I ever made as well.

In 2013 the us congress decided to change the rules with regard to early out and “F’d me.
