You get pulled over by a LEO....

One of the first things out of my mouth when approached by an officer is that I have a pistol on my person and a toter's permit for it. And as posted above I already have the DL, Firearms Permit, Insurance Card out, Dome light and flashers on, window down, keys on dash and my hands in plain sight. My thinking for this is just like the female GSP's over reaction to being told about a gun in the car, how does she react if she spots it on you? I'd rather not have a jumpy officer pointing a weapon at me so I attempt to diffuse the situation before it escalates to that point. No, it's not required in GA to inform the officer that you are armed, but I know that anything I can do to put them a little more at ease when they meet me, increases the odds that I won't be accidentally shot by a rookie that spots a gun and reacts by pulling theirs.

I also try to get my GFL and DL out before they get to my window but if they are fast, i just keep my hands on the wheel and tell them. Usually i get taken out of the car but usually nothing bad. one bad incident recently though was. Sheriff pulled me over for failure to maintain lane because i hit a pot hole and the car veered to the right just a bit. remind you, i never once crossed into the other lane but still. he got to the window and i handed him my permit and DL and he flipped. Was taken out of the car while he radioed for back up and once he felt 6 additional units with lights and sirens was enough, he gave me a very very "detailed" pat down and took my firearm. at that point, he also found my handcuffs. i work in macon as a loss prevention manager and have to handcuff someone all the time so they stay on me. he tried to work every angle to hook me up for impersonation of an officer but it never worked out. it was fun though, didnt have anything better to do and this guy was flipping out so it was kinda fun to watch.
 
A few months ago we left the range and my buddy was in his wife's car and he gets pulled over an expired tag. The officer see's the holstered gun on the seat and of course takes it and runs the numbers. Is an expired tag probable cause to run the gun serial #? If he had a dvd player in the seat would the cop run the serial #'s on it? How about a laptop on the seat? Maybe the GPS on the dash?

Of course, this was used as a leverage to suppress the detection of contraband, so that the contraband could not be legally placed in evidence, and no conviction could therefore arise on the contraband.

If such a search/investigation (NCIC Check) is made, against your stated wishes on a legally owned weapon, and there was no other issue, you MIGHT have a civil case, but, IMO, not much of one, as you'll be hard pressed to delineate any liquidatable damages that a Court would recognise.
 
I had the opportunity to ask a Georgia State Trooper this question. He was doing a safety meeting for us at work. He advised not to show or tell unless you are asked. So I don't.

If he doesn't ask then I won't tell. When he asks I'll say. "Sorry sir but I have no illegal weapons in this vehicle."
It's not a lie because I don't own ANY illegal weapons.

My property is my property. Who cares what I have in my vehicle if it's perfectly legal? It's honestly none of his business.

So they have the right to detain my firearm because they feel threatened someone besides them is packin'? To be honest I am more nervous with what the LEO would do because THEY have a gun. Does this mean I get to detain their weapons?

Here in Savannah I have witnessed a lot of poorly trained officers just because the need bodies patrolling. I probably practice, carry, and more experienced than most of those officers with their weapons.

Don't get me wrong. I have experienced some GREAT LEOs. I believe 90% of the LEOs I encounter are great guys. However, that 10% could be my death.

So it's no ones business what I gave legally in my vehicle.
 
I was doing a lock out job one time in peachtree city. The officer stopped me thinking I was breaking into the car. Well long story short he cought on that I was a service provider. He asked to search me and I told him sure. Sure enough he finds my gun. He becomes pissed FAST. "WHY THE PHUCK DID YOU NOT TELL ME YOU HAD A GUN". Um you did not ask? Some LEOS will get pissed if you dont tell them right off. Its not illegal to not tell them unless they ask.
