I wasn't there so I couldn't guess what really happened, but it's his wife, don't you think she is going to say the truck was trying to kill her husband (if nothing else, to keep an even bigger book from being thrown at him)? Besides, they were stopped on the side of 285 (with his car pushed into the wall, sure) when he apparently got out of the car and started shooting, as far as I could tell the driver wasn't facing a life-threatening situation at that point.
