apartment rent/lease question

ya im going to need to review everything

they are trying to pull one over on me and her

I don't think they are trying to pull one over on you. It's been standard practice at every apartment complex I've worked at. Good luck trying to fight it. If it's a complex that is owned by a big management company then the actual leasing office doesn't have any say over the rules. The are really just the messenger on it. I would say this is a battle you're not going to win. If it were me, i wouldn't have said anything. I would just stay there and if they "catch" you they won't know when you started living there. Do exactly what Z3 said. You're just visiting for a few weeks.

the bolded part, i could be agreeable to

im trying to prevent them from forcing me to stay an extra month if she should decide to leave.

really the whole thing sucks, i didnt want an apartment but she is doing me a solid by letting me move in

ill explain everything about that in a fun thread once im moved out, but my current roommate is a nightmare and i cant stay
You aren't staying an extra month, it would be your friend if they write a NEW 12 month lease. Right now there's really no benefit for them to letting you move in.
Just tell them your plan, tell them you are happy to co-sign the existing lease for the existing term and hope they agree. You are still going to have that issue when you apply for a mortgage though.

How phat are your stacks? It will just be another monthly liability you will have to disclose which depending on what you are trying to do might easily put you out of the market you desire.

Even if you sign a lease there is often a provision for her to release you of that liability and assume full liability when you move out. I would ask them about that. Presumably, as long as she can pass the credit check at that time, which she already would have had to do to get the place herself, they should have no problem letting her re-assume full liability. Just make sure you get it in writing.

Leases are written by landlords and/or their lawyers. The lease are intended to protect the landlords/owners financially, legally, conveniently, etc. Never seen a lease written to protect the tenant. I understand your point of view, but I would not yield to your request

right

so if the liability has already been taken up by the initial party, they would ultimately be responsible

so if liability is already covered why the hell do i have to sign a year lease?
A lot of apartments won't rent to felons, if they don't get an application/lease they can't run a background or credit check.

Lease will provide that each party is jointly and severally liable. That is they are both responsible together and separately for all rents and damages.

ok called and spoke to her
she was pretty nice and straight forward. they require a year lease but will simply move me onto the existing lease (april 15 to april 16). i can move out after 4 or 5 months but will need to find a replacement, other than that standard stuff.

the background check is done with TLO or some other program anyway, dont know why they would need anything more than my basic info and a signature to approve running a credit check onme
