Auto open knives?

Last Halloween my son brought the grand kids over. When he got out of the car he was open carrying his Glock. Knowing he didn't have a permit I asked when he got it? His reply..... I didn't, a Henry County cop told me I don't need one to open carry. I told him to take the gun off and put it in his car before he got arrested.

I hope you explained to him that that was fine INSIDE the car, on his property, where he worked with permission and on YOUR property...
 
I was in a pawn shop a while back, city cop, county deputy and a state patrol were in there also, another customer asked about open and CC. Got 3 different answers. I don't remember which officer said what, but answers were

1 "you need a permit to CC but not to open carry"
2 "you need permit for both"
3 "permit for CC, but open carry is not allowed in any case"

Lets hope when or if it comes down to it, we get one who knows the correct answer.

This is exactly right - ask and you will get multiple answers - learned a long time ago to carry parts of the code with me. In keep a file in my car - I KNOW - most of you and most cops dont give a **** - I do.
 
Carrying a legal reference with you isn't a bad idea. That's why we wrote this book.

It's got all the gun laws of the State of Georgia and laws about knives and other weapons, too.

No, it doesn't have all the local ordinances of each city and county (that's what Municode is good for!) but it does have Code section 16-11-136, which is a form of preemption that applies to knives, but not quite as strongly as 16-11-173 preempts local laws on firearms.

16-11-136 is a fairly new law, passed in 2012. It applies to all knives regardless of blade length. It applies to "any cutting instrument with a blade."

This is covered on pages 110 and 111 of the book.

O.C.G.A. § 16-11-126
Carrying a concealed weapon


(a) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a weapon or long gun on his or her property or inside his or her home, motor vehicle, or place of business without a valid weapons carry license.
Further, OCGA 16-11-125.1 defines what a weapon is:
§ 16-11-125.1. Definitions


As used in this part, the term:

(1) "Handgun" means a firearm of any description, loaded or unloaded, from which any shot, bullet, or other missile can be discharged by an action of an explosive where the length of the barrel, not including any revolving, detachable, or magazine breech, does not exceed 12 inches; provided, however, that the term "handgun" shall not include a gun which discharges a single shot of .46 centimeters or less in diameter.

(2) "Knife" means a cutting instrument designed for the purpose of offense and defense consisting of a blade that is greater than five inches in length which is fastened to a handle.

(3) "License holder" means a person who holds a valid weapons carry license.

(4) "Long gun" means a firearm with a barrel length of at least 18 inches and overall length of at least 26 inches designed or made and intended to be fired from the shoulder and designed or made to use the energy of the explosive in a fixed:

(A) Shotgun shell to fire through a smooth bore either a number of ball shot or a single projectile for each single pull of the trigger or from which any shot, bullet, or other missile can be discharged; or

(B) Metallic cartridge to fire only a single projectile through a rifle bore for each single pull of the trigger;

provided, however, that the term "long gun" shall not include a gun which discharges a single shot of .46 centimeters or less in diameter.

(5) "Weapon" means a knife or handgun.

(6) "Weapons carry license" or "license" means a license issued pursuant to Code Section 16-11-129.



I did not read anything at LexusNexis that says anything about fixed or folding blade
