Driving in the rain without lights on citation.

The legal contention is... Can a public roadway legally be policed by a private entity? If they write tickets where does the money go? If so what's next? Private entitys setting up their own courts and jails?

§ 20-8-2. Law enforcement powers


On the campus of an educational facility, a campus policeman employed by such educational facility who is certified in accordance with Code Section 20-8-3 and when authorized by the governing body or authority of such educational facility shall have the same law enforcement powers, including the power of arrest, as a law enforcement officer of the local government with police jurisdiction over such campus.

Yeah but is it constitutional?
Pretty sure that code section is what is currently being reviewed in the Georgia supreme court.
Now if they want to adequately post, fence off and security gate campuses as private property, have all the residents sign waivers submitting to the will of private police that's one thing, But the public on public roadways should have police answerable to elected public officials, not some private campus review board or generating revenue for private entity's.

GA Tech is a public research university.

GT police is no different from capital police, MARTA police, or postal police.

You guys know I'm not an LEO basher but just playing Devils advocate here.

If there was nothing to it I don't think there would currently be a case pending concerning campus police before the Georgia supreme court.
There is definitely a difference between Capital police (State), Marta transit police (local), Postal police (Feds) they are all accountable to elected officials.
And Campus police (????)
The only thing that makes Tech a public research university is that they get approximately 19% of their budget from state tax dollars. In return they sell their services to those who can pass the entrance exams and pay the tuition worldwide not just to state residents.
HMM ? From sources i gleaned online the annual Tech budget is at $1,000,000,000 per year. Now I'm wondering what the taxpayers of the state get for their $100,000,000 a year or so in appropriations and grants???

If it's just extra cops that don't have to answer to public scrutiny and can to harass folks for traffic offenses we're getting ripped off.
 
They work for the college but their police powers come from the state. The state/POST can and will cracked down on them if they start messing up.

I work EMS for a private company but I still answer to the rules the state sets the same as a fire dept based ems service. The employer doesn't matter as much since they still have to ultimately answer to a government entity.

If the fine is more than about $75 or has points involved
I'd call the prosecutor and see if they will drop it to something non points


Is this gonna be in Fulton county court , city of Atlanta, or do the gabtech revenue collection cops have their own court?

You and I won't decide that, the courts will..in the meantime, which includes right now.. IT IS THE LAW so there's no argument to be made here that will change a thing.

Most of the time I'd agree with you. But GTPD officers are a whole different class than every other college department I have to deal with.
