The reason given for shooting the old man was that they yelled at him to put his hands up and he didn't hear them (hello Mcfly but he is a seasoned citizen and likely didn't hear you) and spun around towards the officers who then shot him. The old guy was reaching for a cigarette. It doesn't matter if the cops were looking for a burglar. They still have the have the responsibility to make sure the man is armed before they pull the trigger and shoot. Telling the judge "we thought he may have been armed" is no defense and you or I would be in jail.

It's said about the outcome but, Need more info from the officers to determine if it was justified or not..Have known several officers that have been in this situation in training video's both with a gun and wallet..you don't know!!! And yes you need to take age as a consideration..Just don't have enough info to quote good or bad decision. DD

Throughout history it has been unlawful to shoot an unarmed person, why change now. I think the deputies should be fired!

The reason I stated it was an opinion as that it may change as more facts come to light.
Perhaps the victim "had a long history of pulling guns on police"
it would sway my "opinion"..

not taking anything as fact at this time

Actually, that's not true. It depends on the situation. If you have reasonable cause to believe all the elements for justifiable use of deadly force exist it is not necessary for any of them to actually exist. A clear example of this would be a man standing 20 yards from you with a rifle screaming he is going to kill you right now. I believe any reasonable person would kill them in self defense at that point. Later it is discovered that the rifle was not loaded and the person did not have any ammo on them. Even if you consider the rifle a club, they were still to far away too be a legitimate threat. The shoot would still be a good one because you obviously had reasonable cause to believe the rifle was loaded.

The same can be true in a situation where a person makes a move as if drawing a weapon. I'm NOT saying this is what happened here. I'm just pointing out that the premise of your statement is incorrect.

You missed the point, this was an UNARMED MAN and did not threaten anyone! Unless you see a gun you should not be allowed to shoot!

No way to call this; as usual with mcnews reports, not nearly enough info- just a headline to grab your attention.

Said nothing about witnesses, or officers dash cams, nothing from the man that was shot who will recover. Why don't they just go cover news they are competent at like a flower show.
